My sincerest apologies about the 46 minute excerpt of audio from the Constitutional Challenge of Section 105 being available on my website. After His Honour discussed the principals of open justice with me at the beginning of the hearing I, with the courts permission, shared the link to the public for anyone that wanted to listen to the case.
After conclusion of the case a number of people in the public contacted me saying they were very thankful that they had an opportunity to hear the matter and some of those people told me that they had recorded parts of the hearing not realising this was any kind of breach.
Some people have sent me copies of those recordings of various lengths, I was not aware as the matter was in open court and because people anywhere could record any of the matter on their devices that it was a breach.
To move quickly in respect of your request I have unpublished the link so that it cannot now be accessed by anyone. Fortunately as this is on my soundcloud account this will prevent anyone anywhere being able to access the audio in all occurrences throughout any republishing of the audio I received throughout all instances on social media.
If you could please confirm with me by checking any instances of the audio you have encountered to double check that this has worked as I believe it has.
I do note respectfully that I was contacted by many different people, many of whom are parents and grandparents who have had their children removed by the state and many who have mentioned that they made recordings.
I will do my best through social media to notify them that to record audio and or video of an open online court is still considered an offence under the act and that the principals of open justice allow them to be welcomed to listen but under no circumstances to record and republish any such information.
If you could please send everyone my sincerest apologies and note that I have removed the audio immediately upon being notified of the republishing of a section of the hearing.
